1. Who you are contracting with
Card and Combat is operated by james chalk (“we”, “us”, “our”), a sole trader trading as Card and Combat. By using the site or buying PokéCoins you enter into an agreement with james chalk. Contact us at support@cardandcombat.com.
2. Acceptance of these terms
By accessing, browsing or continuing to use Card and Combat you agree to these terms. If you do not agree, please stop using the service. If you are under the age required in your country to agree to contracts, you may only use the service with the consent of a parent or guardian.
3. What the service is
Card and Combat is an entertainment web app. It provides AI-generated estimates of Pokémon card values, a simulated card collection with virtual pack openings, catching, grading and evolution, and stat-based Pokémon battles, tournaments, trading and chat between users. Estimated values, grades and pack contents are simulations for entertainment only. They are not offers to buy or sell, not appraisals, and not financial or investment advice. Virtual items, PokéCoins, cards, tickets and trophies exist only inside the app, have no cash value, and cannot be exchanged for money or transferred outside the service.
4. Acceptable use
You must not:
- use the service unlawfully or for any fraudulent purpose;
- send spam, harassment, hateful, obscene or abusive content through chat, trades or profiles;
- infringe anyone’s intellectual property or upload images you do not have the right to use;
- interfere with the security or integrity of the service — including malware, probing, penetration testing, scraping, automated access, exploiting bugs, or manipulating currency, packs or battle results;
- resell, redistribute or attempt to trade virtual items for real money outside the app;
- reverse engineer the service or circumvent technical limits.
5. Your account and content
You are responsible for the accuracy of your trainer name and picture, for keeping any credentials confidential, and for all activity under your account. You keep ownership of the content you upload and grant us a limited licence to host, process and display it solely to operate the service. We may remove content or restrict features that breach these terms.
6. Intellectual property
We retain all rights in the service, including its software, design, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the service for personal, non-commercial enjoyment. Pokémon and all associated names and characters are trademarks of Nintendo, Creatures Inc. and GAME FREAK inc.; Card and Combat is an unofficial fan project and is not affiliated with, endorsed by or sponsored by them. Battle data is sourced from PokéAPI. If you believe content on the service infringes your rights, email us and we will investigate and remove infringing material, and may suspend repeat infringers.
7. Service level
We work to keep the service available, but we do not guarantee uninterrupted or error-free performance. Features may change, be suspended or be withdrawn. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Free service and virtual items
Card and Combat is provided free of charge. There are no purchases, subscriptions or paid currency, and we do not collect payments from you. See our Pricing page and Refund Policy.
PokéCoins, pack tickets, Poké Balls, cards and any other in-game items are a licensed feature of the service, not your property. They have no monetary value, cannot be bought or sold, cannot be exchanged for cash or anything of value, and cannot be transferred off the service. Any card “value” or appraisal figure shown in the app is an informational estimate about real-world collectables and is not an offer, a valuation you can rely on, or a balance you can withdraw.
9. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment or chargeback abuse, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination your access to virtual items ends; you can request an export or deletion of your personal data as described in our Privacy Notice.
10. Liability
We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law. You agree to indemnify us against claims arising from your content, unlawful use of the service, or breach of these terms.
11. General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign your rights without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will change the “last updated” date above; continued use after an update means you accept the revised terms.
